Article 1 – Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

  • Withdrawal Period: The period during which the consumer may exercise the right of withdrawal.

  • Consumer: A natural person acting for purposes outside their trade, business, craft or profession who enters into a distance contract with the trader.

  • Continuing Contract: A distance contract relating to a series of products or services whose delivery or purchase obligations extend over a period of time.

  • Right of Withdrawal: The consumer’s right to withdraw from a distance contract within the applicable withdrawal period.

  • Trader: The natural or legal person who offers products and/or services to consumers remotely.

  • Distance Contract: A contract concluded between the trader and the consumer using one or more means of distance communication.

  • CESOP: The Central Electronic System of Payment Information established by the European Union for the collection and monitoring of certain payment information.

Article 3 – Applicability

These Terms and Conditions apply to offers made by Marina Butik and distance contracts concluded with consumers.

Before a contract is concluded, these Terms and Conditions will be made available in a form that allows the consumer to store and reproduce them.

Nothing in these Terms and Conditions excludes or restricts mandatory consumer rights.

Article 4 – Offers and Pricing

Offers are subject to product availability. We may amend or withdraw offers where legally permitted.

Product descriptions, prices, shipping charges and any other mandatory costs will be displayed as clearly as reasonably possible before an order is placed.

The total price, including applicable taxes and delivery charges, will be displayed before the consumer completes the purchase.

Article 5 – Formation of the Contract

The contract is concluded when the consumer accepts an offer and completes the applicable ordering requirements.

An electronic order confirmation will be sent to the consumer. If an order cannot be accepted or fulfilled, the consumer will be informed and any payment received for the unfulfilled order will be refunded where required by law.

Article 6 – Right of Withdrawal

Consumers in Slovenia and other applicable European Union countries generally have a statutory right to withdraw from an eligible online purchase within 14 days of receiving the goods, subject to legal exceptions.

Marina Butik may offer an extended return period of 30 days under its Return and Refund Policy. This extended period does not restrict statutory rights.

To exercise the right of withdrawal, the consumer must notify the trader clearly within the applicable period.

Unless the trader has agreed otherwise or applicable law provides otherwise, the consumer is responsible for the direct cost of returning goods when exercising the right of withdrawal.

The consumer may be responsible for diminished value resulting from handling beyond what is necessary to establish the goods' nature, characteristics and functioning, as permitted by law.

Article 7 – Refunds Following Withdrawal

Where the consumer validly exercises the statutory right of withdrawal, the trader will reimburse payments received, including the cost of the least expensive standard delivery option offered, where required by law.

Reimbursement will generally be made within 14 days after the trader is informed of the consumer’s decision to withdraw. The trader may withhold reimbursement until the goods have been received or evidence of return shipment has been provided, whichever occurs first, as permitted by law.

Original packaging may be requested where appropriate, but its absence alone will not automatically remove statutory withdrawal rights.

Article 8 – Customs Duties, Import Duties and VAT

The treatment of VAT, customs duties and other import charges depends on the origin of the goods, destination and shipping arrangement.

Any taxes, delivery charges or additional costs payable by the consumer will be disclosed before purchase wherever required by applicable law.

Where a shipment is genuinely sent under Delivered Duty Unpaid (DDU) or a comparable arrangement, the consumer may be responsible for import duties, taxes or customs-clearance charges lawfully payable by the recipient, provided the arrangement is lawful and relevant charges have been appropriately disclosed.

Marina Butik will not represent that the consumer is responsible for charges that the trader is legally required to pay.

The trader and consumer must each comply with the legal obligations applicable to them. Nothing in this article removes statutory rights relating to delivery, cancellation or refunds.

Article 9 – CESOP Compliance

Payment service providers within the scope of applicable European Union regulations may be required to record and report certain payment information under CESOP.

Where applicable, payment information may be processed or reported by the relevant payment service providers in accordance with legal requirements and their respective privacy notices.

Article 10 – Conformity and Legal Guarantee

Marina Butik is responsible for ensuring that products conform to the sales contract and meet applicable statutory requirements.

If a product is faulty, damaged or does not conform to the contract, the consumer may be entitled to repair, replacement, a price reduction, contract termination or another remedy under applicable law.

Consumers should contact customer service as soon as reasonably possible after identifying a problem. Any request to report an issue within a specified period is not intended to shorten or exclude statutory rights.

Article 11 – Delivery

Orders will be delivered within the delivery period displayed at checkout or otherwise agreed with the consumer. Where no other delivery period has been agreed, delivery will generally take place within 30 days, subject to applicable law.

If the trader cannot deliver within the agreed period, the consumer will be informed. The consumer may be entitled to set an appropriate additional period for delivery or terminate the contract and receive a refund in accordance with applicable law.

Delays or customs procedures do not automatically remove the consumer’s statutory rights.

Article 12 – Complaints

Consumers may submit complaints or enquiries by email to marinabutikslovenija@gmail.com or by telephone on +31 6 14113353.

Please include the order number, a description of the issue and any relevant supporting information.

Marina Butik aims to respond to complaints within 14 days. If more time is needed, the consumer will be informed of the expected response time.

This complaints procedure does not limit any statutory rights.

Article 13 – Applicable Law and Disputes

These Terms and Conditions are governed by applicable law, subject to mandatory consumer-protection rules.

Where a consumer habitually resides in Slovenia or another European Union Member State and Marina Butik directs its commercial activities to that country, a choice of law will not deprive the consumer of the protection afforded by mandatory provisions of the law that would otherwise apply.

The parties will endeavour to resolve disputes amicably wherever possible. Consumers retain the right to bring proceedings before any court that has jurisdiction under applicable law.

Consumers may also be entitled to contact relevant consumer-protection authorities or use available alternative dispute-resolution procedures.
